CST AND CHECKOUT IS 10 A.M. CST. NO Early check-ins. This agreement does not create a tenancy or residence. You must depart at the appropriate time. 2. This is a NON-SMOKING unit. 3. Pets are not permitted in rental units under any conditions. 4. We will not rent to vacationing students or singles under 25 years of age unless accompanied by an adult guardian or parent. 5. DAMAGE/RESERVATION DEPOSIT- A damage/reservation deposit of $300 is required. This must be received at the time of booking the reservation. The deposit automatically converts to a security/damage deposit upon arrival. The deposit is NOT applied toward rent; however, it is fully refundable within (14) days of departure, provided the following provisions are met. a. No damage is done to unit or its contents, beyond normal wear and tear. b. No charges are incurred due to contraband, pets or collection of rents or services rendered during stay, or fines levied by the Owners Association. c. All debris, rubbish, and discards are placed in dumpster, and soiled dishes are placed in the dishwasher and cleaned. d. All keys are left on the kitchen table and unit is left locked. e. All charges accrued during the stay are paid prior to departure f. No linens are lost or damaged g. No early check-in or late checkout. h. The renter is not evicted by the owner (or representative of the owner), the local law enforcement or the security company employed by Cedar Heights Condominiums. 6. PAYMENT- Payment in full is due at time of booking. All payments are to be made though PayPal using major credit cards. Please follow the links during the booking process. CANCELLATIONS – A sixty (60) day notice is required for cancellation. Cancellations that are made more than sixty (60) days prior to the arrival date will incur no penalty. Cancellations or changes that result in a shortened stay, that are made within sixty (60) days of the arrival date, forfeit half of the rental charge and the full damage/reservation deposit. Cancellations or changes that result in a shortened stay that are made fourteen (14) days or less of the arrival date forfeit all of the rental charges and damage/reservation deposit. Early departure does not warrant any refund of rent or deposit. 8. MONTHLY RESERVATION CANCELLATIONS – Monthly renters must cancel one hundred twenty (120) days prior to check-in date. Monthly renters who make a change that results in a shortened stay must be made at least ninety (90) days prior to check-in. 9. MAXIMUM OCCUPANCY- The maximum number of guests per condominium is limited to ten (10) persons do to fire code and Home Owner Association Regulations. If the number of quests exceed ten (10) persons you MAY BE subject to a fine. If the owner if fined for conduct of the renters the amount of the fine will be deducted from the deposit. A written copy of the fine will be provided to the renter. 10. THIS PROPERTY REQUIRES A TWO (2) NIGHT MINIMUM STAY 11. INCLUSIVE FEES – Rates include a one-time linen/towel set-up. Amenity fees are included in the rental rate. 12. NO DAILY MAID SERVICE – While linens and bath towels are included in the unit, daily maid service is not included. We suggest you bring beach towels. We do not permit towels or linens to be taken from the units. 13. RATE CHANGES – Rate subject to change without notice. 14. FALSIFIED RESERVATIONS – Any reservation obtained under false pretense will be subject to forfeiture of advance payment, deposit, and/or rental money and the party will not be permitted to check-in. 15. WRITTEN EXCEPTIONS – Any exceptions to the above mentioned policies must be approved in writing in advance. 16. NO DISTURBANCE OF THE PEACE - You will not cause, allow or permit a noise level that disrupts the peace. 17. NO LIABILITY - You will take such steps as necessary and adequate for the protection of yourself and your guests and invitees, and the property of the foregoing, against injury, damage or loss, by insurance, as a self-insurer, or otherwise. We will not be liable for any damage to your property or to any property, goods, or things contained in Unit or on the premises. 18. ATTORNEY FEES - In the event we are required to bring any action at law or in equity against you to enforce this agreement, you agree to pay our reasonable attorney's fees (including appellate fees), as they may be set by the court in which the original action was brought. 19. WAIVER - You agree to release us and our agents, officers, servants and employees of any form of liability, claims, demands, actions, and causes of actions whatsoever, arising out of or related to any loss, damage, or injury, including death, that may sustained by yourself and your guests and invitees while in, on, or upon the premises of the Unit or engaged in any activities or personal property associated with the Unit. You are aware of the risks or hazards inherent upon engaging in such activities or participating in such activities, hereby elects voluntarily to enter upon the premises, and to engage in or participate in said activities knowing that said activities or participation may be hazardous. You voluntarily assume all risk of loss, damage, or injury that may be sustained as a result of such participation and activities. 20. INDEMNIFICATION - You agree to hold us harmless and to indemnify us for any liability, claim, demand, action and cause of action brought by any third party against us arising out of or related to any loss, damage, or injury, including death, that may sustained by said third party while in, on, or upon the premises of the Unit or engaged in any activities or personal property associated with the Unit. 21. ACCEPTANCE OF AGREEMENT - By clicking the below ACCEPT TERMS button, you are agreeing to the terms and condition of this Agreement. You also further agree to sign a hard copy of this Agreement if and when presented to you by us and to return said signed Agreement to us at least fourteen (14) days in advance of your arrival date. Any reservation without a signed Agreement returned at least fourteen (14) days in advance of the arrival date will be subject to forfeiture of advance payment, deposit, and/or rental money and the party will not be permitted to check-in.
